1. Provider and scope

Provider: Devontra KG (Freigrafendamm 11, Bochum). These terms apply to businesses and practices using Devinote as SaaS.

2. Service

Devinote supports clinical documentation via live transcription, text summary and export. It is an assistive tool and does not replace medical judgement, diagnosis or treatment.

3. Account, licence and seats

Use requires a registered account and a valid licence/subscription (including trial where offered).
Licence owners may assign seats per plan. Credentials must not be shared with unauthorised persons.
Abuse (e.g. sharing beyond purchased seats) may result in suspension.

4. Clinical responsibility

Healthcare professionals ensure patients are informed / consent is obtained as required by law. Outputs must be clinically reviewed before use.

5. Data protection

The Privacy Policy applies. Transcript/note text is not stored permanently in the app database; transcription/AI processing uses named processors.

6. Fees and term

Fees follow the selected plan (e.g. Stripe Checkout/Portal). Trials end as offered. Cancellation and invoices are handled via the customer portal / account management where enabled.

7. Availability

We aim for high availability but do not warrant uninterrupted service. Maintenance, cloud outages or force majeure may affect use.

8. Liability

Unlimited liability for intent, gross negligence and injury to life, body or health. For slight negligence, only essential contractual duties, limited to foreseeable typical damage. Liability for accuracy of AI output is excluded to the extent permitted; clinical review remains with the user.

9. Changes

We may update these terms prospectively where legitimate interests require it, and will provide suitable notice of material changes.

10. Final provisions

German law applies, excluding CISG. If the customer is a merchant, venue is the provider’s seat where permitted. Severability applies.
